Are you ready for the GDPR?
You are probably already aware that the General Data Protection Regulation (GDPR) will come into effect on 25th May 2018. This regulation introduces new requirements for how organizations process personal data. All businesses will have to comply with GDPR and after 25th May 2018, the failure of an organization, employees, or contractors to comply could result in a legal investigation and a fine.
As a customer or collaborator of Mandelay Kft. you should note that we only collect data from you which you have agreed to give us, or have agreed we can have. For instance, when you purchase a device we register your name, address, email and telephone number, since this is information we are legally required to store in order to maintain records of device ownership. Please note that if you unsubscribe from the Mandelay Kft newsletter, this only refers to marketing communications, as we cannot remove your personal information completely from our records due to regulatory reasons.
To ensure compliance in our organization, we have appointed Mr. Andras Csaszi as Data Protection Officer for Mandelay Kft. As a practitioner you also need to understand that you are storing GDPR-relevant information about your clients in the software of your SCIO / EDUCTOR /Mandelay Q9 device, especially the information that you collect in the demographics panel. This data is encrypted in the database, but you should take additional measures to protect this information from being accessible by others. Specifically, this means:
- When you received your device, you were provided with a 4-digit pin code as password for the software. Unless you have done so already, you need to change this initial pin code to a different, personalized one. In future releases of the software, we will introduce a password check, but in the meanwhile we recommend to use at least a 6-digit pin code. Please make sure you memorize the pass code.
- you must not leave your computer unattended, if the SCIO - EDUCTOR software is active and unlocked. Use the Windows button + L incase the Windows has password
- you must not allow anybody to view client information on the computer, unless it is the client itself.
- You have to ensure that third parties do not have the possibility to access or view personal client information. This means
- For your demonstration, you should preferably use a laptop/software that does not contain any real client data.
- If this is not possible, you should backup the client database prior to the demonstration, then delete the client data from the software and do the presentation. Afterwards, you can re-import the client data from the backup.
- For brokers, or other practitioners who are demonstrating the device to prospects or other interested parties, additional rules apply.
Additional protection is given for both sales representatives and practitioners by enhancing the protection levels of their computers. This means using a properly maintained and up-to-date operating system with password protection, an anti-virus program and a local firewall.
To be compliant with your own country's data privacy regulations, consult your local data protection authorities and/or advisor!
The new Clasp64 software features new pictures and videos, and bug fixes. Regarding the new GDPR regulation in the EU, we made the database much safer to comply with both GDPR and HIPAA requirements. The new version of Clasp64 will be available from the middle of June for all SCIO, EDUCTOR big screen and Mandelay Q9 owners!
In addition, all clients of yours should sign an informed consent form, in which they confirm that they have understood that you are storing certain personal data, including some medical data. The form needs to contain
- the name of the client,
- information about the data that is collected,
- information how the data is protected and processed,
- a statement of consent,
- the signature of the client.
Attached, we have prepared a sample that you can use for this purpose. Please note that this informed consent is also required for subspace sessions. In this case, you can send the content of the form to the client via email and ask for a reply email stating “I have read and understood the information and give my consent”, followed by the name of the client.
You need to keep the signed forms for your records, since you eventually will have to prove that you have obtained consent from your clients.
